Philly DA Sues to Stop Elon Musk’s Million-Dollar Giveaway to Battleground Voters — As Musk Resumes Contest Despite DOJ Warning
Philadelphia’s district attorney is suing Elon Musk’s “America” PAC to stop it from giving away $1 million a day to registered voters in battleground states who sign a petition to “support the Constitution.”
D.A. Larry Krasner filed the suit in Philadelphia Common Pleas Court Monday, saying his office is charged with “protecting the public from public nuisances and unfair trade practices, including illegal lottery.”
The suit comes as the political action committee, described on X as a “PAC Founded by @ElonMusk to support candidates who champion Secure Borders, Sensible Spending, Safe Cities, Fair Justice System, Free Speech and Self-Protection,” posted a photo of a new winner from the battleground state of Michigan.

Last week, the U.S. Department of Justice warned Musk that the giveaway may violate federal laws banning “inducements to voters— considering that only registered voters in battleground states are eligible.
The billionaire responded to the warning during a town hall-style broadcast on his X social media platform last week, saying, “To be clear, this is not a petition to vote for or register for anyone. It’s really a petition in support of the Constitution of the United States, and in particular, freedom of speech and the right to bear arms.”
Musk took the stage at Sunday night’s controversial MAGA rally at New York’s Madison Square Garden where he described his all-black ensemble as “dark gothic MAGA.” He encouraged the crowd to vote early for Donald Trump and claimed he could cut $2 trillion from the U.S. budget.
If he’s elected, Trump has promised that he would appoint Musk to a new cabinet position: “secretary of cost cutting.”
