Former Trump White House Lawyer Calls Judge Aileen Cannon ‘A Stain’ on the Judiciary After She Blocks Release of Smith Report

 

Ty Cobb, a former lawyer in the first Trump White House, did not hold back on U.S. District Judge Aileen Cannon after she blocked the release of a Department of Justice report about the ill-fated classified documents case against President-elect Donald Trump.

On Tuesday, Cannon enjoined Special Counsel Jack Smith from sharing his report until the 11th Circuit Court of Appeals can weigh in. The decision was widely criticized, as many legal experts questioned the basis (or lack thereof) on which Cannon made it.

Trump appointed Cannon in 2020, and since then she has made a slew of rulings favorable to him after drawing the documents case. The president-elect was indicted in 2023 for what Smith said was Trump’s willful retention of classified documents after leaving office. Smith alleged Trump also obstructed the government’s efforts to retrieve them.

Cannon dismissed the documents case in July by dubiously ruling that Smith’s appointment was illegal.

Hours after Cannon ruled to block the report on Tuesday, Cobb appeared on CNN’s OutFront.

“So, Ty, Judge Aileen Cannon tonight – Trump’s knight in shining armor,” host Erin Burnett said.

“Oh, yes, she’s very reliable on his behalf,” he replied.

Burnett then played clips of Trump praising Cannon’s decision earlier in the day in which he repeatedly called her “brilliant.”

“Why do you think, Ty, Cannon blocked the report?” the host asked.

“The only reason she’s shining is, she’s his tool and he polishes her religiously,” Cobb responded. “He gets the results he needs from her. The 11th Circuit has already, as we know, over two years ago, had to admonish her extensively.”

Cobb was referring to Cannon’s appointment of a special master shortly after the FBI executed a search warrant at Mar-a-Lago in 2022. The search turned up a trove of government documents. At the time, Trump’s lawyers asked for a special master to review the material. Cannon ruled in Trump’s favor, but this was short-lived, as the 11th Circuit vacated her decision in harsh fashion.

Cobb said Cannon “had created remedies for [Trump] out of whole cloth.”

“I suspect they will do so again quickly,” he said of the 11th Circuit. “[T]hey may be prepared to mitigate the stain that she is and the stain that she’s created again for the judiciary quickly on this.”
